THE ALLEGATIONS
What VoIP-PAL alleges, in plain language.
VoIP-PAL alleges that Apple, Alphabet, Samsung, AT&T, Verizon, and T-Mobile have together structured access to native smartphone telephony in a way that forecloses competition from independent Wi-Fi calling providers.
Specifically, the complaints allege that platform providers control OS-level permissions — the Lock — that determine which services can integrate with the native dialer and function as standalone telephony replacements; and carriers control network credentials — the Key — required to activate native telephony functionality, and that equivalent authorization is not available to independent providers through the same pathway.
The complaints allege that these two mechanisms together condition access to full native telephony on the purchase of a carrier subscription bundle — and that this structure has implications under federal antitrust and class action law.
Motions to dismiss are pending. VoIP-PAL has filed responses and an opposition to a motion to compel arbitration. All statements here reflect VoIP-PAL's allegations only and have not been adjudicated.
THE PATENT PORTFOLIO
Approximately 40 issued patents covering Wi-Fi-based mobile communications technology, developed over two decades.
VoIP-PAL's subsidiary Digifonica was co-founded by Emil Malak in 2003 and spent more than two decades developing internet-based telephony technology. The resulting portfolio covers: classification and routing of communications, lawful intercept, mobile gateway technology, emergency assistance calling, allocating charges, and uninterrupted transmission during network transitions.
Patents have been granted in the United States, Europe, Canada, India, Indonesia, and Brazil. The portfolio was acquired by VoIP-PAL.com Inc. in 2013. The patents have been reviewed and upheld through multiple Inter Partes Review proceedings.
